- Any issue attributable to the service must be reported promptly within the warranty period.
⚠️ 3. Diagnostic Policy
The diagnostic service is not covered under warranty and is non-refundable under any circumstances.

- This service requires specialized equipment, time, and qualified technicians; therefore, it has an independent cost that cannot be refunded or claimed.
- The customer cannot request a refund for diagnostic fees, even if they choose not to proceed with the repair or if the ECM is determined to be non-repairable.
- Warranty applies only to the repair portion actually performed, not to the diagnostic evaluation.

- No other warranties, express or implied, exist beyond what is described in this document.
- No reseller or representative is authorized to modify or extend this warranty.
6. Exclusion of Consequential and Incidental Damages
Neither the original purchaser nor any subsequent user shall be entitled to recover consequential or incidental damages, including but not limited to:
- Loss of income or profit
- Towing or transportation expenses
- Loss of vehicle use or downtime
7. Warranty Claim Procedure
To obtain warranty service, the original purchaser must:
- Complete the RMA form at https://ecmrepairusa.com/rma-from-repair-order-and-terms-of-service-agreement/ within the applicable warranty period, describing the issue with as much detail as possible (symptoms, fault codes, photos, videos, diagnostic data, and the shop or technician who performed the installation).
- Immediately after completing the RMA form, ship the ECM to ECM ENGINEERING LLC, 137 North Highland Street, Mount Dora, FL 32757, USA (shipping costs are the customer’s responsibility). No prior approval call or confirmation is required: the RMA form is not reviewed before the unit is shipped, and ECM ENGINEERING LLC does not provide phone assistance for RMA submissions. Units received without a completed RMA form will not be processed.
- Shipping notification: After shipping the ECM, email sales@ecmrepairusa.com with the customer’s name, the brand and part number of the module, confirmation that the RMA form was completed, and the tracking number of the shipment. Units received without this notification may experience delays in identification and processing.
- Ensure that all warranty labels remain intact and unaltered.
At the discretion of ECM ENGINEERING LLC, we may:
- Repair the defective ECM when it has been submitted for service or reprogramming; or
- Replace it with an equivalent and functional unit only when it was sold directly by ECM ENGINEERING LLC as a replacement product.
ECM ENGINEERING LLC will evaluate the unit within five (5) business days after receipt and issue a report with the resolution. Repairs or replacements will be completed within a reasonable timeframe after receipt of the ECM.
8. Conditions That Void the Warranty
The warranty will be void if the ECM shows any of the following:
- Evidence of water or moisture intrusion
- Broken, missing, or tampered warranty labels
- Removed or altered serial numbers
- Signs of unauthorized manipulation or repair attempts
- Electrical overvoltage, short circuits, or reverse polarity
- Physical damage, corrosion, or burnt components
- Bent pins, broken connectors, or damaged circuits
- Improper use, neglect, or poor maintenance
These conditions apply to both repaired ECMs and replacement units sold by ECM ENGINEERING LLC.
Modules purchased under “final sale” promotions are not eligible for return.
9. Customer Support
Your satisfaction and confidence are essential to us.
If your warranty claim has not been resolved to your satisfaction, please contact us directly so we can assist you promptly and professionally.
10. Return and Refund Policy
For ECMs sold as new or refurbished, returns for refund are accepted only within thirty (30) calendar days from the delivery date, as shown on the carrier’s tracking. After 30 days, returns are eligible for exchange or store credit only; no refunds will be issued. NO EXCEPTIONS. Any refund request must strictly follow the process below:
- The customer must first return the ECM unit to ECM ENGINEERING LLC for inspection, following the RMA procedure in section 7.
- No refund will be processed unless the ECM has been physically received and verified by our technical department.
- Once received, the ECM will be evaluated and tested to confirm its electronic and physical condition.
- Depending on the evaluation results, ECM ENGINEERING LLC may authorize a partial or full refund.
- Customers cannot demand reimbursement or file chargebacks without first returning the ECM for technical evaluation.
Returns not related to a defect or performance issue, including after installation or testing, are subject to the following fees, deducted from any refund:
- Heavy-Duty, Machinery/AG, and Marine line: a restocking and programming fee of US $600 for modules sold with standard programming. If any customization or special request was performed, an additional US $350 applies, for a total of US $950.
- Light-Duty line (VW, Audi, MB Sprinter): a 20% restocking fee plus a US $85 programming fee. If the module was sold with keys, an additional US $90 key fee applies. Original shipping is not refunded.
If the ECM is returned with sand, dust, oil, diesel, or other external contamination, or with signs of installation or handling, and ECM ENGINEERING LLC confirms that the module is in good working condition, the return will be treated as a voluntary return and the fees above will be deducted from any refund.
This policy ensures proper verification of each returned unit and protects the integrity of our quality assurance process.
11. Shipping & Transportation Liability
The Customer acknowledges and agrees that all shipments of electronic modules,
including but not limited to ECM, ECU, PCM, TCM, or similar units, are transported
by independent third-party carriers (such as UPS, FedEx, USPS, or others), over
which ECM ENGINEERING LLC has no control.
11.1 Inbound Shipments (Customer to ECM ENGINEERING LLC)
The Customer is solely responsible for all inbound shipping costs and assumes all
risks associated with transportation to ECM ENGINEERING LLC.
Although ECM ENGINEERING LLC may provide a shipping label as a
convenience, inbound shipments are not insured by default.
This applies to shipments for any warranty claim, return, technical evaluation, or refund request, whether domestic or international, regardless of the outcome of the claim. Inbound shipping costs are non-refundable.
If shipping insurance is desired, the Customer must request it
in writing prior to shipment and pay the additional insurance
cost. ECM ENGINEERING LLC shall not be liable for any loss, theft,
damage, delay, or destruction occurring during transit to our facility, including
but not limited to drops, impacts, crushing, moisture, improper packaging,
mishandling, or carrier-related accidents.
11.2 Outbound Shipments (Return to Customer)
Return shipping of the repaired unit may be paid by
ECM ENGINEERING LLC as a courtesy. Payment of return shipping
does not constitute acceptance of liability for the unit while
in transit.
For free reprogramming of an initial failure, or restoration of the original programming within the programming warranty period, ECM ENGINEERING LLC covers return shipping only for addresses within the United States; for international addresses, return shipping, customs fees, and duties are the Customer’s responsibility.
ECM ENGINEERING LLC shall not be responsible for any loss, theft,
or damage occurring during return shipment, even when shipping costs are paid by
the company. Shipping insurance is not included unless expressly
requested in writing by the Customer and paid for prior to dispatch.
11.3 Force Majeure and Carrier Events
In the event of total loss, severe damage, or force majeure events during
transportation — including but not limited to vehicle accidents, rollovers,
fires, theft, strikes, delays, acts of God, or natural disasters — liability shall
rest solely with the carrier and/or any applicable shipping insurance, if
purchased.
By submitting a unit to ECM ENGINEERING LLC, the Customer confirms
that they have read, understood, and agreed to the terms outlined in this
Section 11.
11.4 Shipping Responsibility
ECM Repair USA is not responsible for loss, damage, or delays caused by shipping carriers during transit to or from our facility.
Once the package has been handed over to the shipping company, all responsibility lies with the carrier.
Customers are strongly advised to use a reliable shipping service, include tracking information, and purchase shipping insurance when sending their ECM.
In the event that a package is lost, stolen, or damaged in transit, the customer must file the claim directly with the shipping carrier. No refunds, replacements, or credits will be issued by ECM Repair USA for shipping-related incidents.
12. OEM Programming and Installation
- Every control module sold by ECM ENGINEERING LLC is delivered with the original manufacturer (OEM) programming. ECM ENGINEERING LLC does not perform emissions system deletions, configurations, or modifications, in compliance with U.S. federal emissions regulations. Any previous tuning or modification of the customer’s original module will not be reproduced; tuning, when available, is offered as a separate service.
- Plug-and-play operation is not guaranteed. Installation must be performed by a qualified technician following the manufacturer’s specific procedures for each application, starting with the use of the manufacturer’s specialized diagnostic tool. Any on-site configuration required by the equipment is the customer’s responsibility and is not a defect.
- For any warranty claim, the customer must provide the name of the shop or technician who performed the installation and the report or fault codes obtained from the diagnostic tool.
Caterpillar / Perkins: Transmission configuration and pairing with other modules must be done on site, using original Cat ET and an authorized Caterpillar technician. This is not a limitation on our side: those parameters require the engine and modules to be connected and, in several cases, Caterpillar factory passwords. They cannot be performed on a bench.
Volvo / Cummins: These brands cover multiple applications (trucks, marine, construction, agricultural, generator sets, and others), each with its own manufacturer installation procedures, which must be consulted in the service manual of the corresponding engine.
Volkswagen / Audi: Before programming, the customer must send a clear photo of the part number label of the original control module. ECM ENGINEERING LLC will use it to verify whether the module must be cloned. If cloning is required, the customer must send the original control module to our laboratory, so that the cloned module is intended to allow the vehicle to start upon installation, subject to the general installation requirements of these Terms & Conditions. If ECM ENGINEERING LLC does not request the original control module, the new module will be programmed from scratch.
Mercedes-Benz Sprinter: ECM ENGINEERING LLC sells Sprinter control modules only when the customer sends, in all cases, their original control module (including a damaged or non-working unit) to be cloned. The customer receives a refurbished control module programmed with data cloned from their original unit, designed to be installed without additional coding or programming, subject to the general installation requirements of these Terms & Conditions.
13. Conditions of Sale for Control Modules
- Prior diagnosis: By purchasing a control module, the customer represents that their original control module has been diagnosed as defective by a qualified technician before ordering. The control module supplied by ECM ENGINEERING LLC is not a diagnostic or testing tool and may not be used to determine whether the customer’s original module was faulty. A return because the original module was not faulty is a voluntary return, subject to the fees in section 10.
- Correct initial operation: If the control module operates correctly upon installation, this confirms that the module and its programming were correct at the time of delivery. Any later failure will be subject to technical evaluation. It will be covered only if ECM ENGINEERING LLC confirms an internal defect attributable to the module, within the applicable warranty period.
- Product condition: Control modules sold by ECM ENGINEERING LLC may be new or remanufactured. The condition of each module (new, or original manufacturer unit remanufactured and electronically customized to the customer’s engine) is stated in the invoice or product description for that sale. All modules are tested before shipment.
- Accuracy of customer information: The customer is solely responsible for the accuracy of all information provided in the Programming Order, including the engine serial number, VIN, ECM part number, software version, and application. ECM ENGINEERING LLC will program the control module based exclusively on that information. Any error in that information is not a defect of the module or the service; any reprogramming required as a result will be charged separately, and shipping costs remain the customer’s responsibility.
- Inspection upon receipt: The customer must inspect the package and the control module immediately upon receipt. Any visible damage, missing items, or discrepancy with the part number ordered must be reported in writing within three (3) calendar days of the delivery date, with photos of the package and the module. If no report is received within that period, the control module shall be deemed accepted as delivered in good physical condition and matching the order.
- Customer-supplied module – testing fee: When the customer sends their own module for programming, cloning, or tuning, the module will first be tested. If the module is found defective, cannot be programmed or cloned, or no problems are found, a $200 testing fee plus shipping cost will apply. This testing fee is non-refundable. In this case, we will process a partial refund of the remaining balance paid, minus the testing fee and shipping cost.
- Tuning programming: By requesting tuning programming, the customer represents that the engine is in good mechanical condition and meets the conditions required for tuning, and that the customer expressly authorizes the service. Any consequence that tuning (including Stage 1) may have on the engine, drivetrain, or equipment is the sole responsibility of the customer. ECM ENGINEERING LLC always keeps a backup of the original programming; if the tuning does not work as expected, ECM ENGINEERING LLC can restore the control module to its original version free of charge within the thirty (30) day programming warranty period, with return shipping covered as described in section 11.2. After that period, the restoration will be charged at the rate quoted by ECM ENGINEERING LLC at the time of the request. The customer agrees to indemnify and hold harmless ECM ENGINEERING LLC from any claim by third parties arising from the use of the tuned module, and is solely responsible for ensuring that its use complies with the laws and regulations applicable where the vehicle or equipment operates.
14. Programming Order, Order of Precedence and Governing Law
For ECM sales and programming services, the signed Programming Order and Terms of Service Agreement contains the complete terms of the sale, including brand-specific installation requirements, tuning terms, fees, and governing law. In the event of any conflict, the documents apply in the following order: (1) the signed Programming Order; (2) these Terms & Conditions; (3) the Returns Policy; (4) the RMA form.
These Terms & Conditions are governed by the laws of the State of Florida, United States of America, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply. Any dispute shall be submitted exclusively to the state or federal courts located in Lake County, Florida.
